These Terms of Service ("Terms") govern your access to and use of the RoomStylerAI mobile application (the "App") provided by RoomStylerAI ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

RoomStylerAI is an AI-powered interior and exterior design application that allows users to:

  • Upload photographs of rooms, house exteriors, or hand-drawn sketches.
  • Select from various design styles, room types, transformation modes, and color preferences.
  • Generate AI-powered redesigned images of their spaces using Google Gemini AI.
  • Save, compare, download, and share generated designs.

2. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App, in compliance with the Children's Online Privacy Protection Act (COPPA) and the General Data Protection Regulation (GDPR). By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account and Authentication

  • The App uses anonymous authentication. No personal account registration (email, password, etc.) is required.
  • An anonymous identifier is automatically created when you first use the App. This identifier is linked to your device and is used to manage your gallery, credits, and subscription status.
  • Important – Risk of Data Loss: Because the App uses anonymous authentication with no account recovery mechanism, if you uninstall the App, reset your device, or clear the App's data, your anonymous account and all associated data — including your saved designs, credit balance, and gallery — will be permanently and irreversibly lost. We cannot recover this data. We strongly recommend downloading any important designs to your device photo library before uninstalling.

4. Credits and Free Tier

  • Free-tier users receive a limited number of credits upon first use. Each AI room generation consumes one credit.
  • Additional credits may be earned by watching rewarded video advertisements within the App.
  • Credits are non-transferable and have no monetary value. Credits cannot be exchanged, refunded, or converted to cash.
  • We reserve the right to modify the credit system, including the number of initial credits, credits earned per ad, and credits required per generation, at any time without prior notice.

5. Subscriptions and Payments

5.1 PRO Subscription

  • The App offers PRO subscription plans that provide unlimited room transformations and an ad-free experience.
  • Subscription plans, pricing, and durations (weekly, monthly, or yearly) are presented within the App at the time of purchase. The subscription price is displayed in the App prior to purchase and may vary by region and currency.
  • Some subscription plans may include a free trial period. If you do not cancel at least 24 hours before the free trial period ends, you will be automatically charged for the subscription at the then-current rate. Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same service.

5.2 Billing and Renewal

  • All subscriptions are billed through the Apple App Store or Google Play Store, depending on your device.
  • Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
  • Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate then in effect.

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your device's subscription settings:
  • iOS: Go to Settings > [Your Name] > Subscriptions > RoomStylerAI > Cancel Subscription.
  • Android: Go to Google Play Store > Menu > Subscriptions > RoomStylerAI > Cancel Subscription.
  • Cancellation takes effect at the end of the current billing period. You will continue to have PRO access until the end of your paid period.
  • Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
  • You may restore previous purchases using the "Restore Purchases" option in the App's Account settings.

6. User Content

6.1 Your Photos

  • You retain ownership of any photographs you upload to the App.
  • By uploading a photo, you grant us a limited, non-exclusive, worldwide license to process, transmit, and store the image solely for the purpose of generating your AI-redesigned image and maintaining your gallery.
  • By using the App, you acknowledge and agree that your uploaded images will be transmitted to Google's Gemini AI service for processing. Google's use of such data is governed by Google's AI Terms of Service and Privacy Policy.
  • You represent and warrant that you have the right to upload and use any photographs you submit, and that such photographs do not infringe on any third party's intellectual property rights, privacy rights, or any applicable laws.

6.2 AI-Generated Content

  • AI-generated images produced by the App are provided for your personal use. PRO subscribers may additionally use AI-generated images for limited commercial purposes, such as sharing with contractors, interior designers, or in real estate listings. Resale of AI-generated images as standalone digital products is prohibited without our prior written consent.
  • Due to the nature of AI-generated content, such images may not be eligible for copyright protection in all jurisdictions. You use AI-generated content at your own risk regarding intellectual property claims. RoomStylerAI does not claim ownership of AI-generated images.
  • You may download, save, and share AI-generated images, including on social media.
  • AI-generated images are created by artificial intelligence and may not be architecturally accurate, structurally sound, or suitable for actual construction or renovation purposes. They are intended for inspiration and visualization only.
  • We do not guarantee the accuracy, quality, or suitability of any AI-generated content.

7. Prohibited Uses

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Upload images that contain illegal content, nudity, violence, hate speech, or content that exploits minors.
  • Upload images that you do not have the right to use or that infringe on third-party rights.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
  • Attempt to bypass, disable, or circumvent any security features, credit system, or subscription verification mechanisms.
  • Use automated means (bots, scrapers, etc.) to access the App or generate images.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Use the App to create content that misleads others into believing AI-generated images are real photographs for fraudulent purposes.

8. Intellectual Property

  • The App, including its design, code, features, graphics, icons, logos, and branding, is owned by RoomStylerAI and is protected by applicable intellectual property laws.
  • The RoomStylerAI name, logo, and associated branding are our trademarks. You may not use them without our prior written permission.
  • All third-party trademarks, service marks, and logos used in the App are the property of their respective owners.

9. Advertisements

  • The App may display rewarded video advertisements to free-tier users, served by Google AdMob.
  • Watching advertisements is voluntary and is offered as a means to earn additional credits.
  • We are not responsible for the content of third-party advertisements. Any interactions with advertisers are solely between you and the advertiser.

10. Disclaimers

  • THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • AI-generated images are for inspirational and entertainment purposes only. They should not be relied upon for architectural, structural, engineering, or construction decisions. You acknowledge that AI-generated content may contain inaccuracies or artifacts.
  • We do not guarantee specific results from using the App. The quality and style of AI-generated images may vary depending on input image quality, selected options, and AI model performance.
  • We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without prior notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL ROOMSTYLERAI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR THE EQUIVALENT OF 50 EUR, WHICHEVER IS GREATER.
  • SOME JURISDICTIONS, INCLUDING MEMBER STATES OF THE EUROPEAN UNION, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless RoomStylerAI and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the App.

This indemnification obligation shall not apply to the extent prohibited by applicable consumer protection laws in your jurisdiction, including but not limited to the EU Unfair Contract Terms Directive (93/13/EEC) and its national implementations.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of government, war or terrorism, internet or telecommunications failures, third-party service outages (including AI service providers such as Google Gemini), power failures, strikes, epidemics, or pandemics.

14. Termination

  • We may suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you violate these Terms.
  • Upon termination, your right to use the App ceases immediately. Any data associated with your anonymous account may be deleted.
  • Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Third-Party Beneficiaries) shall survive termination.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and where practicable, providing notice within the App. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you should discontinue use of the App.

16. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-law provisions.
  • Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation.
  • If a dispute cannot be resolved through negotiation, it shall be submitted to the competent courts in Poland.
  • If you are a consumer residing in the European Union, you retain any mandatory protections provided by the consumer protection laws of your country of residence, and nothing in these Terms shall affect your statutory rights as a consumer. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Third-Party Beneficiaries

Apple Inc. and Google LLC are third-party beneficiaries of these Terms to the extent required by the Apple Media Services Terms and Conditions and the Google Play Developer Distribution Agreement, respectively. Upon your acceptance of these Terms, Apple and Google shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as third-party beneficiaries thereof.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. These Terms are binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RoomStylerAI regarding your use of the App and supersede any prior agreements, communications, or understandings.
