These Terms of Service ("Terms") govern your access to and use of the Restyle AI mobile application (the "App"), provided by Favai (Borys Kusmirek), based in Wrocław, Poland ("we," "us," or "our"). The App is listed on Google Play as "Restyle AI: Interior Design" and on the Apple App Store as "Restyle AI", under the package and bundle id com.roomstylerai. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Restyle AI is an AI-powered interior and exterior design application that allows users to:

  • Upload photographs of rooms, house exteriors, or hand-drawn sketches.
  • Select from various design styles, transformation modes, and colour, flooring, material and lighting libraries. The App does not ask which room is in the photograph; it does ask whether the photograph is an interior, a house exterior or a garden.
  • Generate AI-powered redesigned images of their spaces using third-party AI image models.
  • Save, compare, download, and share generated designs.

2. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use the App, in compliance with the Children's Online Privacy Protection Act (COPPA) and the General Data Protection Regulation (GDPR). By using the App, you represent and warrant that you meet this age requirement. If you are under the age of 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account and Authentication

  • The App uses anonymous authentication. No personal account registration (email, password, etc.) is required.
  • An anonymous identifier is automatically created when you first use the App. This identifier is linked to your device and is used to manage your gallery and subscription status.
  • Important – Risk of Data Loss: Because the App uses anonymous authentication with no account recovery mechanism, if you uninstall the App, reset your device, or clear the App's data, your anonymous account and all associated data — including your saved designs and gallery — will be permanently and irreversibly lost. We cannot recover this data. We strongly recommend downloading any important designs to your device photo library before uninstalling.

4. Who May Generate Designs

  • Generating a design requires an active PRO subscription. There is no free allowance, no trial generation and no credit balance. Without a subscription you may install and open the App, browse it, choose a photograph and set every control, but the App will not generate an image.
  • The App does not award, sell or grant credits of any kind, and there is no way to earn generations by watching advertisements or by any other means.
  • Designs generated before 11 August 2026, when the App still operated a credit system, remain viewable, savable and shareable. Any credit balance recorded on your device before that date no longer entitles you to a generation.
  • Generation is subject to the usage limits in section 5.4.

5. Subscriptions and Payments

5.1 PRO Subscription

  • The App offers PRO subscription plans. A PRO subscription is the only way to generate designs in the App, and it is subject to the usage limits in section 5.4. We do not describe any plan as unlimited.
  • Subscription plans, pricing, and durations (weekly, monthly, or yearly) are presented within the App at the time of purchase. The subscription price is displayed in the App prior to purchase and may vary by region and currency.
  • Some subscription plans may include a free trial period. If you do not cancel at least 24 hours before the free trial period ends, you will be automatically charged for the subscription at the then-current rate. Any unused portion of a free trial period will be forfeited when you purchase a subscription to the same service.

5.2 Billing and Renewal

  • All subscriptions are billed through the Apple App Store or Google Play Store, depending on your device.
  • Payment will be charged to your Apple ID or Google Play account at the confirmation of purchase.
  • Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the subscription rate then in effect.

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your device's subscription settings:
  • iOS: Go to Settings > [Your Name] > Subscriptions > Restyle AI > Cancel Subscription.
  • Android: Go to Google Play Store > Menu > Subscriptions > Restyle AI > Cancel Subscription.
  • Cancellation takes effect at the end of the current billing period. You will continue to have PRO access until the end of your paid period.
  • Refunds are handled by Apple or Google in accordance with their respective refund policies. We do not process refunds directly.
  • You may restore previous purchases using the "Restore Purchases" option in the App's Account settings.

5.4 Usage Limits

  • A PRO subscription allows up to 150 generated designs per day. The count resets at 00:00 UTC.
  • A short cooling-off interval of 30 seconds applies between one generation and the next. It applies to every user, including subscribers.
  • A generation that fails does not count against your daily total; the slot is returned to you automatically.
  • Every transformation mode, style, colour, material, lighting setup and space type is included on every plan. Plans differ only in length and price.
  • These limits exist so that a single account cannot exhaust our AI provider capacity. We may adjust them, and will state the current figures in the App.

6. User Content

6.1 Your Photos

  • You retain ownership of any photographs you upload to the App.
  • By uploading a photo, you grant us a limited, non-exclusive, worldwide license to process, transmit, and store the image solely for the purpose of generating your AI-redesigned image and maintaining your gallery.
  • By using the App, you acknowledge and agree that your uploaded images will be transmitted to OpenAI for processing by its image models. OpenAI's use of such data is governed by the OpenAI Business Terms and Privacy Policy.
  • You represent and warrant that you have the right to upload and use any photographs you submit, and that such photographs do not infringe on any third party's intellectual property rights, privacy rights, or any applicable laws.

6.2 AI-Generated Content

  • AI-generated images produced by the App are provided for your personal use. PRO subscribers may additionally use AI-generated images for limited commercial purposes, such as sharing with contractors, interior designers, or in real estate listings. Resale of AI-generated images as standalone digital products is prohibited without our prior written consent.
  • Due to the nature of AI-generated content, such images may not be eligible for copyright protection in all jurisdictions. You use AI-generated content at your own risk regarding intellectual property claims. Restyle AI does not claim ownership of AI-generated images.
  • You may download, save, and share AI-generated images, including on social media.
  • AI-generated images are created by artificial intelligence and may not be architecturally accurate, structurally sound, or suitable for actual construction or renovation purposes. They are intended for inspiration and visualization only.
  • We do not guarantee the accuracy, quality, or suitability of any AI-generated content.

7. Prohibited Uses

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Upload images that contain illegal content, nudity, violence, hate speech, or content that exploits minors.
  • Upload images that you do not have the right to use or that infringe on third-party rights.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the App.
  • Attempt to bypass, disable, or circumvent any security features, usage limits, or subscription verification mechanisms.
  • Use automated means (bots, scrapers, etc.) to access the App or generate images.
  • Interfere with or disrupt the App's servers, networks, or infrastructure.
  • Use the App to create content that misleads others into believing AI-generated images are real photographs for fraudulent purposes.

8. Intellectual Property

  • The App, including its design, code, features, graphics, icons, logos, and branding, is owned by Restyle AI and is protected by applicable intellectual property laws.
  • The Restyle AI name, logo, and associated branding are our trademarks. You may not use them without our prior written permission.
  • All third-party trademarks, service marks, and logos used in the App are the property of their respective owners.

9. Advertising

  • The App displays no advertisements. There are no banner ads, no interstitials and no rewarded video ads, and there is no way to earn anything by watching one.
  • We do advertise the App elsewhere. With your permission, given through Apple's App Tracking Transparency prompt on iOS or the equivalent consent mechanism on Android, we measure which of our own advertisements led you to install it. See our Privacy Policy.

10. Disclaimers

  • THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
  • AI-generated images are for inspirational and entertainment purposes only. They should not be relied upon for architectural, structural, engineering, or construction decisions. You acknowledge that AI-generated content may contain inaccuracies or artifacts.
  • We do not guarantee specific results from using the App. The quality and style of AI-generated images may vary depending on input image quality, selected options, and AI model performance.
  • We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without prior notice.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL RESTYLE AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR THE EQUIVALENT OF 50 EUR, WHICHEVER IS GREATER.
  • SOME JURISDICTIONS, INCLUDING MEMBER STATES OF THE EUROPEAN UNION, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Restyle AI and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload to the App.

This indemnification obligation shall not apply to the extent prohibited by applicable consumer protection laws in your jurisdiction, including but not limited to the EU Unfair Contract Terms Directive (93/13/EEC) and its national implementations.

13. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to: natural disasters, acts of government, war or terrorism, internet or telecommunications failures, third-party service outages (including AI service providers), power failures, strikes, epidemics, or pandemics.

14. Termination

  • We may suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you violate these Terms.
  • Upon termination, your right to use the App ceases immediately. Any data associated with your anonymous account may be deleted.
  • Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Third-Party Beneficiaries) shall survive termination.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and where practicable, providing notice within the App. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you should discontinue use of the App.

16. Governing Law and Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict-of-law provisions.
  • Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation.
  • If a dispute cannot be resolved through negotiation, it shall be submitted to the competent courts in Poland.
  • If you are a consumer residing in the European Union, you retain any mandatory protections provided by the consumer protection laws of your country of residence, and nothing in these Terms shall affect your statutory rights as a consumer. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Third-Party Beneficiaries

Apple Inc. and Google LLC are third-party beneficiaries of these Terms to the extent required by the Apple Media Services Terms and Conditions and the Google Play Developer Distribution Agreement, respectively. Upon your acceptance of these Terms, Apple and Google shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you as third-party beneficiaries thereof.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

19. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing.

20. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. These Terms are binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Restyle AI regarding your use of the App and supersede any prior agreements, communications, or understandings.
